1. Acceptance of the terms
These Terms of Service (“Terms”) are a binding agreement between you and MoveLead (“MoveLead,” “we,” “us,” or “our”). By accessing or using movinglead.co or any related services (collectively, the “Services”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
2. Our services
MoveLead operates a lead-generation platform for moving companies. We attract homeowners actively searching for movers and deliver verified leads to participating moving companies via SMS, email, or CRM. We may add, modify, or discontinue features of the Services at any time.
3. Eligibility and accounts
To use the Services as a moving company, you must be at least 18 years old and authorized to enter into these Terms on behalf of the business you represent. You are responsible for keeping the information you provide accurate and up to date.
4. Lead purchases and no long-term contracts
We offer different lead products, which may include shared leads, exclusive leads, and live call transfers for local and long-distance moves. Pricing is presented on the Site and may be updated from time to time. You can start, pause, or stop purchasing leads at any time; there are no long-term contracts.
Lead availability is not guaranteed and depends on the service areas you select, consumer demand, and other factors. We do not guarantee the conversion rate, revenue, or business outcome from any lead.
5. Billing, refunds, and credits
You agree to pay all fees associated with the leads you purchase. We may charge fees to the payment method you authorize. Our lead-replacement or credit policy, if any, will be communicated to you separately. Except as required by law, all payments are non-refundable.
6. Your obligations
As a user of the Services, you agree to:
- Provide accurate, current, and complete information on forms, calls, and all communications;
- Contact leads only for legitimate purposes related to providing moving services and in compliance with applicable laws (including TCPA, TSR, CAN-SPAM, state do-not-call rules, and state licensing requirements);
- Use lead information only for your own use and not resell, redistribute, or share it with third parties without MoveLead’s written permission;
- Follow the opt-out and suppression instructions of any consumer who asks not to be contacted;
- Maintain any licenses and insurance required to operate.
7. TCPA, SMS, phone, and email consent
When a consumer or business submits a form on our Site, they provide express consent to be contacted by MoveLead and its partners via SMS, phone (including autodialed or pre-recorded calls), and email. When you purchase leads from MoveLead, you agree to contact those leads only in accordance with the scope of consent provided and in compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the CAN-SPAM Act, and all other applicable federal, state, and local laws. You are solely responsible for your own outreach practices and for maintaining records of consent, do-not-call lists, and opt-outs.
8. Prohibited uses
You agree not to:
- Violate any law, contract, intellectual property, or third-party right;
- Upload or transmit malicious code, spam, or other harmful content;
- Scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Services;
- Use leads in a manner that harasses, defrauds, or deceives consumers, or that violates consumer protection laws;
- Resell or share lead information without our written permission;
- Interfere with the security, integrity, or performance of the Services.
9. Intellectual property
The Services and all content, trademarks, logos, and other materials on the Site (excluding content you provide) are owned by MoveLead or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms.
10. Third-party links and services
The Services may contain links to third-party sites or services that we do not control. We are not responsible for the content, policies, or practices of any third party.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components, or that leads will result in any specific business outcome.
12. Limitation of liability
To the fullest extent permitted by law, MoveLead and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, goodwill, or data, arising out of or related to your use of the Services. Our total liability to you for any claim arising out of or related to the Services will not exceed the amounts you paid to MoveLead in the three (3) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless MoveLead and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services; (b) your violation of these Terms; (c) your contact with consumers or leads, including any alleged violation of the TCPA, TSR, CAN-SPAM, or similar laws; or (d) your violation of any third-party right.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services immediately ceases. Sections that by their nature should survive termination will survive.
15. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which MoveLead is headquartered, without regard to its conflict-of-law rules. The parties agree to the exclusive jurisdiction of the state and federal courts located in that state for any disputes not subject to arbitration. Nothing in this section waives your non-waivable rights under applicable law.
16. Changes to the terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Effective date” above. Your continued use of the Services after we post changes means you accept the updated Terms.
